In his practice, Mr. Atwell represents employers in a wide range employment law matters before state and federal courts, as well as in arbitration and mediation before the Equal Employment Opportunity Commission, relating to, e.g. discrimination, wrongful discharge, retaliation, violation of the Hawaii’s Whistleblowers’ Protection Act, violation of public policy, violation of non-compete agreement, breach of contract, agency appeal of Department of Labor and Industrial Relations penalty assessments, and other employment/labor-related matters. Mr. Atwell also represents multi-employer bargaining associations against anti-trust claims arising under federal and state law. In addition to his litigation services, Mr. Atwell advises clients on various employment issues including employee discipline and discharge.
Mr. Atwell graduated cum laude from the Maurice A. Deane School of Law at Hofstra University. While at Hofstra Law, Mr. Atwell served as a Notes & Comments Editor on Volume 31 of the Hofstra Labor & Employment Law Journal. Mr. Atwell also taught a special section on international sales and commercial arbitration for the Willem C. Vis International Commercial Arbitration Moot at Hofstra Law, worked as Real Estate Finance & Investment Associate at Alston & Bird, LLP in New York, and interned with the Environmental Enforcement Section of the U.S. Department of Justice. Mr. Atwell is a co-author of Drug Testing Laws: Hawaii and Leave Policy Language: Hawaii, published in Practical Law online. Mr. Atwell is admitted to practice law in Hawaii and New York.
